Privacy Policy for the use of the app visiono© gamma

Preamble

The visiono© gamma app can currently only be used by commercial users with a corresponding license key.

As the provider of the app, we assure you that the protection of all data we process about you and your customers in the app is our highest priority. Therefore, we collect, process, store and delete your data in accordance with the legal regulations. These are, in particular, the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) and other legal bases such as the German Telecommunications Telemedia Data Protection Act (TTDSG) in the field of electronic communications.

With the following information, we would like to give you an overview of the processing of your data by us and your rights under data protection law.

3. Collection, storage and use of personal data

3.1. Feedback& Support Request

If you send us feedback or a support request, or use the support form on our website, your email address will only be used for correspondence with you and to clarify your support case. As a matter of principle, data will not be passed on to third parties.

3.2. Licensing

We offer different license models for the use of the visiono© gamma  app, which differ from each other in terms of their range of functions.

The visiono© gamma app requires the entry of a license key.

Within the scope of licensing, only the data that is absolutely necessary for activation will be processed. Depending on the respective license agreement, you will receive a corresponding license key.

All data collection and processing is carried out for specific purposes. These may arise from technical necessities, contractual requirements or explicit user requests. We use the processed data exclusively for the execution of the contracts and agreements concluded with you.

3.3. Use of the visiono©gamma app

As part of the installation, licensing and activation of the visiono© gamma app and for product updates, an Internet connection is required once. In this context, we also receive information from you as a user about your iOS-version, your in-app purchases, your IP-address, the device language you have set, as well as the date and time of your request.

An internet connection is no longer required to operate the visiono© gamma app after successful activation.

When using the visiono© gamma app, your customer's biometric data in the form of a facial image will be collected and processed for the purpose of calculating the centering data after your customer has given their voluntary and explicit consent.

This data will only be stored locally on your device and will not be passed on to third parties under any circumstances.

Even during the subsequent calculation and the associated collection, processing and use of the centering data, the storage takes place exclusively locally on your end device.

At no time, not even with an existing internet connection, will facial images or centering data be transmitted to us or to third parties without explicit authorization. The centering data remains on your device.

After automatic pseudonymization, in which the centering data is assigned to an order number, you can send the centering data to the manufacturer/supplier by e- mail with the help of the iOS app Mail.

A forwarding of the biometric data in the form of the facial image is technically excluded.

3.4. Newsletter

If you subscribe to one of our newsletters, you will only do so with your voluntary consent. Your e-mail address can then be used by us for advertising purposes. You can revoke your consent for the future at any time and unsubscribe from the newsletter by clicking on the unsubscribe link in the newsletter.

4. Collection, storage and use of non-personal data

4.1. App crash

In the event of a crash of the visiono© gamma app, it may manually or automatically send us information about the functions you are currently accessing, provided that you agree to this in advance. This information allows us to respond more quickly to any problems that may arise and thus also to offer you a corrected version of the app via the App Store© more quickly. The data transmitted in this process does not allow any conclusions to be drawn about a specific user.

5. Permissions requested by the app and how to use them

5.1. Camera

The visiono© gamma app requires access to the camera on your device.

5.2. Mobile data

As an alternative to the Wi-Fi connection, a mobile data connection can be used.

6. Data security

All security technologies we use are state-of-the-art and are constantly updated. Our security concepts are continuously adapted to new findings and updated in order to protect all data processed in the visiono©gamma app from theft and misuse. All data is processed according to the highest security standards for data processing.

Personal data will only be processed to the extent personally authorized by you. In doing so, we only collect and process the data that is absolutely necessary for the maintenance and use of the visiono© gamma app. All functions and services that process personal data will inform you of the exact scope of the data before using and transferring your data and will require your confirmation of the transfer. All  data processed in the visiono© gamma app belongs to you, therefore we do not pass on any of the data transmitted to us to third parties without your consent, unless we are legally obliged to do so, such as in the event of a court order to do so.

6.1. Technical safeguards

6.1.1. Server of visuSolution GmbH

All servers we use are operated in DIN ISO/IEC 27001 certified data centers. The hardware used is designed to be fail-safe and redundant. As a matter of principle, we do not store data on other servers, in particular not on servers outside the European Union. Corresponding contracts have been concluded with the service providers involved in accordance with Art. 28 GDPR.

6.1.2. Data transmission

Your data will only be transmitted via SSL/TLS encrypted connections from your device to our servers operated in DIN ISO/IEC 27001-certified data centers. The certificates are checked for validity and, if technically possible on a platform, the fingerprints of the certificate are also checked to prevent misuse and man-in-the-middle attacks.

6.1.3. Data processing and storage

All data processed in the visiono© gamma app is processed and, if necessary, stored exclusively on servers operated by us and protected by us against access by third parties by means of extensive technical and organizational safeguards.

6.1.4. Data erasure on your local device

All of your customers' data processed locally on your end devices in the visiono© gamma app will be completely and irrevocably automatically deleted after 1 week (default setting), but no later than 8 weeks after the order has been placed, depending on the customer's request when consent is given.

6.2. Organizational safeguards

By means of appropriate technical and organizational measures, even with physical access to the systems, the data cannot be read out or assigned to specific users via different systems.

6.3. No disclosure to third parties

The data will only be passed on to third parties without your consent if we are legally obliged to do so, e.g. in the event of a corresponding court order.

6.4. Transfer to a third country or international organisations

A transfer of data to a third country or international organisations is excluded.

6.5. Automated individual decision-making including profiling

Automated decision-making or profiling techniques are not used.

7. Standard deadlines for the erasure of data

The legislator has enacted a wide range of retention obligations and periods. At the end of these periods, the relevant data will be routinely erased. In addition, we erase data on the instructions of our clients. If data is not affected by this, it will be erased when the purpose of processing no longer applies and thus there is no longer a legal basis for further processing.

8. Rights as a data subject

In accordance with Art. 12 et seq. GDPR, you have the right to revoke your consent (Art. 7 (3) GDPR), to information (Art. 15 GDPR), to rectification (Art. 16 GDPR), to erasure (Art. 17 GDPR), to restriction of processing (Art. 18 GDPR), to data transferability (Art. 20 GDPR), to object (Art. 21 GDPR), to lodge a complaint with a supervisory authority (Art. 77 GDPR) as well as to an effective judicial remedy (Art. 78 and 79 GDPR).

You can exercise these rights either with us or with our external data protection officer.

9. Actuality and changes to this privacy policy

This privacy policy is currently valid and has the following status: November 2023.

Due to the further development of our products and offers or due to changes in legal or regulatory requirements, it may become necessary to change this privacy policy. The latest version is automatically made available in the visiono© gamma app or in the App Store©.
